We are in receipt of your notice tot he industry that effective
September 2nd the attached export requirements must be fulfilled.
It should be also noted that we received this notice from the
International Grains Bureau on September 2nd, i.e. the same date these
requirements will take effect.
On receipt of this notice we immediately notified all our truckers
and buyers that your requirements had to be fulfilled.
With this in mind we carried on with our truck shipments to the U.S.
from Ontario on Tuesday, September 6th and instructed our truckers to
leave the proper documentation with Revenue Canada Customs office oat
the Bluewater Bridge in Sarnia.
Our truckers are now reporting that Revenue Canada Customs personnel
at Sarnia say that they do not have to have, nor do they want, the
documentation that you are requesting, or demanding, in the aforementioned
notice to the industry.
In fact some of the personnel in Sarnia are refusing to accept
these documents that we are now required to submit.
How can we possibly comply with your rules and regulations if your
offices of Revenue Canada customs are not aware of them, nor will they accept
our documentation?
With the above in mind we want to go on record that under no
circumstances will we be held liable for any fines or penalties that
might be imposed under the new Customs Act.
For your information and guidance we have now instructed further that
our truckers must have the Canadian Customs office sign that they have
received a copy of the proper Export Documentation for each and every
load we are shipping to the U.S.A.
Would you please confirm in writing your acknowledgment of receipt of
this fax along with an acknowledgment stating that we will be exempt
from any penalties for shipments made from September 2ne until your
offices at Revenue Canada Customs are notified of your new rules and
regulations.
